7Notes LLC maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and 7Notes LLC. If you do not agree to these terms, do not use this Site.
1. Use of Site
7Notes LLC provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). 7Notes LLC authorizes each User to view and download one copy of the Materials that are made available for download through the course. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.
2. Geographic location
If you, as a User, purchase Materials from this Site or 7Notes LLC while outside of Canada, you may not user or access the materials while in Canada.
3. User Warranty
As a User you warrant that you are not an agent or employee of any other music education company and the Site and Materials solely for the purpose of learning.
4. Trademark and Copyright
LearnCarnatic, and certain other brands, trademarks, and service marks are marks of 7Notes LLC and its affiliates. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.
5. Hyperlinks
Links to external websites are provided solely as a convenience to you. 7Notes LLC has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.
6. No Warranty
The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. 7Notes LLC further does not warrant the accuracy and completeness of the Materials at this Site. 7Notes LLC may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and 7Notes LLC makes no commitment to update the Materials at this Site.
7. Limitation of Liability
In no event will 7Notes LLC, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

The Terms of Use are governed by the laws of Georgia, USA. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. 7Notes LLC may assign its rights and duties under the Terms of Use without notice to any party at any time.
9. Effective Date and Updates
The Terms are effective as of June 1, 2020 and are subject to change without notice by 7Notes LLC at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
ADDIITIONAL TERMS OF USE:
1. These Terms of use constitute a binding legal agreement between You and Mr. Vinod Krishnan (‘the Producer’).
2. These terms are in addition to and supplement the Thinkific Inc. (‘Thinkific’) OTT Terms of Service and all other terms agreed to by you, the Subscriber, by making an account on Thinkific and choosing to subscribe to LearnCarnatic (‘the Service’).
3. The Service is a proprietary, unique, and original pedagogical methodology developed for the learning of Indian Classical vocal music by the Producer. The videos that make a part of this Service are original, including the content thereof. All intellectual property rights existing in the video content uploaded as a part of the Service vest absolutely with the Producer.
4. By agreeing to subscribe to the Service, you agree:
(a) To only use the content available on this page for your personal, non-commercial use;
(b) To not download, copy, warp, amend, alter, edit or in any way distort the content of any text, audio or video content made available by the Producer on Thinkific;
(c) To not use in any manner whatsoever the videos or the content of the videos for commercial gain, including but not limited to (i) unauthorizedly downloading the said videos; (ii) Copying in any form and to whatever extent the content of the videos and publishing the same for commercial gain; (iii) making derivative works from the content of the videos and publishing the same for commercial gain or otherwise; (ii) using the video and the content thereof for any purpose besides personal recreational use.
(d) To not resell streams or downloads, use any of the videos or the content thereof for any commercial purpose, redistribute or retransmit any video, publicly perform or display any video;
(e) All rights not expressly granted herein are reserved by the Producer.
5. By agreeing to subscribe to the Service you acknowledge that the content of the videos uploaded by the Producer is entirely original and unique, and that all intellectual property rights, including but not limited to copyright, existing in the content of the videos uploaded by the Service/Producer, vest solely with the Producer.
6. Usage of the Service as a method of training is predicated on Your physical and mental fitness. By subscribing to the Service you hereby declare that you are of sound mental and physical health, and of a level of physical fitness that will allow personal usage of the video without causing any injury, damage or harm to your physical and mental health. Any training undertaken by You as a result of having viewed videos published by the Producer is solely at your own risk.
7. Any disputes arising out of or in connection with this agreement shall be subject to the jurisdiction of the courts in Atlanta, Georgia, USA.
Disclaimer and Waiver
As the student/legal parent/guardian, I understand that my/my child's participation in online or in-person music courses, or off site events with 7NotesLLC and Vinod Krishnan may expose me/him/her to unforeseen risk of personal injury, death or property damage. I hereby acknowledge that I am voluntarily participating/allowing my child to participate in all lessons and events and agree to assume any such risks.
I hereby release, discharge and agree not to sue 7NotesLLC and Vinod Krishnan, its wonders, directors, agents, faculty or employees and future successors for any injury, death or damage to or loss of personal property arising out of or in connection with my/my child's participation in any lessons or events from whatever cause, including the active or passive negligence of 7NotesLLC or Vinod Krishnan, staff or any other participants of 7NotesLLC.
In consideration for being permitted to participate in the class, I hereby agree, for myself/my child, my heirs, administrators, executors and assigns, that I shall indemnify and hold harmless 7NotesLLC and Vinod Krishnan from any and all claims, demands, actions or suits arising out of our in connection with my/my child's participation in any of the LLC's events.
I give 7NotesLLC and Vinod Krishnan permission to authorize emergency medical personnel to carry out such emergency diagnostic and therapeutic procedure as may be necessary for myself/my child, and also permit such treatment procedures to be carried out at, and by local hospitals for myself/my child in the event of an emergency. I understand that any medical expenses will be billed directly to me or my insurance company.
I hereby release, discharge and agree not to sue 7NotesLLC and Vinod Krishnan, its wonders, directors, agents, faculty or employees and future successors for any decision pertaining to my/my child’s participation and progress in online or in-person classes or off site events.
I affirm that I have read, understand and agree to be bound by the terms and conditions of this contract for music instruction through 7NotesLLC and Vinod Krishnan. I fully understand that failure to abide by this contact will result in termination of this agreement and membership in 7NotesLLC will be revoked immediately. I understand that I can also review these policies any time online.
